Backgrounders and research

When the OHRC issues a news release or does a public launch of something, there is usually more information than we can fit into a release.

For people who want “the story behind the story,” we often prepare backgrounders - short handouts that provide more details on certain parts of a story. For example, they could talk about the process the OHRC used to decide on something, or the chronology of events.

The OHRC also does both internal and external research to help it make the best decisions. This research could be included in a backgrounder, or can appear on its own as a research report or paper.

Most landlords and housing providers try to comply with the Ontario Human Rights Code and work hard to meet the needs of their tenants. However, for some tenants, discrimination in housing is not an unusual occurrence. The lack of affordable and adequate housing, when combined with overt and subtle discrimination in housing, means that many people protected by the Code are excluded from the housing market, forced to pay higher rents than they can actually afford, or relegated to poor quality housing options.

NIMBY opposition to affordable housing development was a major human rights issue raised by consultees, including both tenant advocates and housing providers. People should not have to ask permission from anyone, including prospective neighbours, before moving in just because of stereotypes relating to grounds under the Ontario Human Rights Code (Code). Concerns about affordable housing projects should be legitimately anchored in planning issues rather than stereotypical assumptions about the people who will be housed.

In May 2007, the Commission initiated a public consultation with the launch of background and consultation papers both entitled Human Rights and Rental Housing in Ontario. Beginning in June 2007, the Commission held public and private meetings in four cities across the province to hear about the extent of the problems and to identify potential solutions. Around 130 organizations and an additional 24 individuals participated in afternoon consultation meetings in Kitchener-Waterloo, Ottawa, Sudbury and Toronto, and over 100 people participated in evening sessions in these locations.

Unfortunately, there is still significant stigma and stereotype about mental illness, and a lack of understanding of rights relating to mental illness as a disability.

With the recent passage of the Accessibility for Ontarians with Disabilities Act (AODA), 2005, accessibility issues are now governed by complementary aspects of the Ontario Human Rights Code, the AODA, the Ontario Building Code and, in the case of existing buildings, the Ontario Fire Code.

2007 - Three complainants filed complaints against various film exhibitors and distributors regarding accessibility of movies to the deaf, deafened and hard of hearing community which were referred by the Ontario Human Rights Commission to the Human Rights Tribunal of Ontario. The complainants and the exhibitor parties (the “Exhibitors”) have agreed to a settlement which includes an incremental increase in the number of theatre complexes with the capability to exhibit movies with closed captioning.

July 2007 - Over the past few years in efforts to resolve human rights complaints, the Ontario Human Rights Commission (OHRC) approached the Toronto Police Services Board (TPSB) and the Toronto Police Service (TPS) to include specific public interest remedies.

July 2007 - The Ontario Human Rights Commission has reached a settlement with a complainant and Cadillac Fairview Corporation Limited in a complaint alleging racial discrimination.

July 2006 - The Ontario Human Rights Code creates a right to barrier-free restaurants, shops, hotels, movie theatres and other public places, and obliges businesses operating in Ontario to make their facilities accessible. A failure to provide equal access to a facility or equal treatment in a service constitutes a violation of the Human Rights Code. The only available defence to such discrimination is showing that providing access or services would constitute undue hardship having regard to cost, outside sources of funding, or health and safety factors.

July 2006 - For the past five years, the Ontario Human Rights Commission (the "Commission") has been working closely with the restaurant industry to improve accessibility for persons with disabilities, older individuals, and families with young children.
