Goods, services and facilities

 

You have the right to be free from discrimination when you receive goods or services, or use facilities. For example, this right applies to:

  • stores, restaurants and bars
  • hospitals and health services
  • schools, universities and colleges
  • public places, amenities and utilities such as recreation centres, public washrooms, malls and parks
  • services and programs provided by municipal and provincial governments, including social assistance and benefits, and public transit
  • services provided by insurance companies
  • classified advertisement space in a newspaper.

  1. Submission of the OHRC to the MGCS regarding name and sex designation change information

    May 23, 2016 - The OHRC believes that MGCS’ current system for storing and sharing information relating to name and sex designation changes discriminates against trans people in violation of Ontario’s Human Rights Code, insofar as it fails to protect privacy and confidentiality relating to transgender status and transition history. Disclosing information of such a sensitive nature not only harms dignity, but also can expose people to significant barriers, disadvantage, and even health and safety risks.

  2. Letter to the Ministry of Education regarding the provincial and demonstration schools consultation

    April 6, 2016 - Dear Minister, I write in regard to your Ministry’s current consultation involving certain provincial and demonstration schools for students with disabilities. Under Ontario’s Human Rights Code, students with disabilities have a right to be free from discrimination. This includes the duty to accommodate students’ disability related needs. That duty also covers the accommodation process and everyone involved.

  3. Access to locker rooms for trans amateur hockey players: J.T. v. Hockey Canada et. al.

    Background

    This case involved a transgender boy, Jesse Thompson, who was denied access to the boys’ locker room the rest of his amateur hockey team used during the 2012-2013 hockey season. Jesse alleged that this resulted in him being ‘outed’ as trans, excluded from important team interaction and bonding, and exposed to harassment and bullying.

  4. Cole v Ontario (Health and Long-Term Care) : Challenging the funding limits to live in community settings

    Background

    The applicant, Ian Cole, is a middle-aged man with a severe intellectual disability who lives in the community. To live in the community, Mr. Cole depends on the receipt of nursing services. The primary source of funding for the nursing services is his local Community Care Access Centre (CCAC). The maximum funding for nursing services is set out in a regulation made under the Home Care and Community Services Act, 1994.  At the time the application was filed, funding was available for nursing services to a maximum of four visits per day.

  5. Settlement relating to Toronto Police Service Memorial Wall

    November 11, 2015 - the Ontario Human Rights Commission (OHRC) filed an Application with the Human Rights Tribunal of Ontario (HRTO) alleging discrimination in employment based on disability because of the Toronto Police Service’s (TPS) failure to include on its Memorial Wall officers who end their lives as a result of a mental health disability incurred in the line of duty. On April 18, 2017 a settlement was reached with the following terms...

  6. RE: University-Mandated Leave of Absence Policy ­raises human rights concerns

    I am writing today to outline the Ontario Human Rights Commission’s concerns regarding the University of Toronto’s proposed University-Mandated Leave of Absence Policy which is being considered by the University Affairs Board tomorrow (January 30, 2018). The OHRC is concerned that the treatment of students contemplated in the Policy may result in discrimination on the basis of mental health disability contrary to the Human Rights Code.

  7. With learning in mind

    In 2016, the Ontario Human Rights Commission (OHRC) wrote to public colleges and universities in Ontario asking them to implement six specific measures to reduce systemic barriers to post-secondary education for students with mental health disabilities. This report describes the systemic barriers identified by the OHRC, the modifications to post-secondary institutions’ policies and procedures requested by the OHRC, and the institutions’ self-reported progress in implementing the requested changes.
