Goods, services and facilities

 

You have the right to be free from discrimination when you receive goods or services, or use facilities. For example, this right applies to:

  • stores, restaurants and bars
  • hospitals and health services
  • schools, universities and colleges
  • public places, amenities and utilities such as recreation centres, public washrooms, malls and parks
  • services and programs provided by municipal and provincial governments, including social assistance and benefits, and public transit
  • services provided by insurance companies
  • classified advertisement space in a newspaper.

  1. Correction: Toronto Police Service body–worn camera pilot project

    Toronto - Several news outlets have recently quoted a Toronto Police Service (TPS) news release regarding body-worn cameras: http://torontopolice.on.ca/newsreleases/31840

    That release says, in part:

    The Service has partnered with the Information & Privacy Commissioner, the Ontario Human Rights Commission, the Ministry of the Attorney General and the Toronto Police Association to develop a procedure that addresses issues of privacy, retention, and disclosure. 

    This statement is not accurate.

  2. Count me in! Collecting human rights based data - Summary (fact sheet)

    2010 - Many people think that collecting and analyzing data that identifies people on the basis of race, disability, sexual orientation and other Ontario Human Rights Code (Code) grounds is not allowed. But collecting data on Code grounds for a Code-consistent purpose is allowed and is supported by Canada’s human rights legislative framework. This summary is a brief overview of some of the key points raised in the guide.

    2010 - This guide is intended to be a practical resource for human resources professionals, human rights and equity advisors, managers and supervisors, unions, and any other people or groups considering a data collection project, or seeking support to do so. This guide may be particularly helpful to readers with little or no knowledge of data collection. The guide will discuss the benefits of data collection, and will highlight key concepts and practical considerations for organizations thinking of gathering data on Code and non-Code grounds. Appendices A to F offer concrete examples of how non-profit, private and public-sector organizations have successfully developed and implemented data collection projects.
  4. Creed case law review

    May 2012 - What follows is a discussion of significant legal decisions dealing with religious and creed rights in Canada. The focus is on decisions made since the Commission issued its 1996 Policy on Creed and the Accommodation of religious observances. It does not review every decision, but those that may be important from a human rights perspective. In addition to a description of the case law, trends and areas where it is anticipated the case law will continue to evolve or be clarified are identified. The review will form the basis for further research and dialogue concerning the law in Canada as it relates to this significant area of human rights.

  5. de Lottinville and the application of Section 45.1 of Ontario's Human Rights Code

    February 25, 2015 - In the past, people who experienced discrimination or harassment by police had to decide whether to file an officer misconduct complaint under the Police Services Act (“PSA”) or an application with the Human Rights Tribunal of Ontario (“HRTO”). The PSA provides a public complaints process, revised through amendments in 2009 which also established the Office of the Independent Police Review Director (“OIPRD”). If they filed both, there was a real risk that their HRTO application would be dismissed.

    The Ontario Human Rights Code guarantees the rights of persons with disabilities to equal access to adequate, dignified transportation. For the reasons set out in its 2002 consultation report, Human Rights and Public Transit in Ontario, the Ontario Human Rights Commission has long been concerned by the significant barriers that persons with disabilities face when attempting to access transportation services. I am writing to share two recent developments in the area of transit and human rights, and to request that you provide the Commission with information on your organization’s accessibility efforts with regard to the announcement of transit stops.

    We were encouraged this week to hear Ontario’s Solicitor General and Minister for Community Safety and Correctional Services announce plans to regulate police street checks across Ontario.

    The Minister was clear about what he wants: “to prevent unjustifiable police stops for no reason or without cause”. HOW to do this will be the difficult part – but ending “unjustifiable police stops” that amount to racial profiling is our goal.
