May 23, 2016 - The OHRC believes that MGCS’ current system for storing and sharing information relating to name and sex designation changes discriminates against trans people in violation of Ontario’s Human Rights Code, insofar as it fails to protect privacy and confidentiality relating to transgender status and transition history. Disclosing information of such a sensitive nature not only harms dignity, but also can expose people to significant barriers, disadvantage, and even health and safety risks.
Goods, services and facilities
You have the right to be free from discrimination when you receive goods or services, or use facilities. For example, this right applies to:
- stores, restaurants and bars
- hospitals and health services
- schools, universities and colleges
- public places, amenities and utilities such as recreation centres, public washrooms, malls and parks
- services and programs provided by municipal and provincial governments, including social assistance and benefits, and public transit
- services provided by insurance companies
- classified advertisement space in a newspaper.

This case involved a transgender boy, Jesse Thompson, who was denied access to the boys’ locker room the rest of his amateur hockey team used during the 2012-2013 hockey season. Jesse alleged that this resulted in him being ‘outed’ as trans, excluded from important team interaction and bonding, and exposed to harassment and bullying.
In July 2015, the OHRC intervened in a Human Rights Tribunal of Ontario Application concerning the treatment of trans persons in custody.
July 8, 2016 - In pursuit of our public interest mandate, section 31 of the Code authorizes the OHRC to request production of documents and gather other information as part of an inquiry. Pursuant to section 31, we are writing to request that you review employee dress codes in your Ontario operations, remove any discriminatory requirements, and provide documentation showing that you have done this.
May 16, 2017 - Dear Councillor El-Chantiry, Today the Ottawa Police Services Board is receiving the results of Phase III of the Ottawa Police Services Gender Project. As you know, the project arises out of a settlement reached with the Ontario Human Rights Commission (Commission) in a human rights case filed by a female Ottawa Police Services (OPS) officer.
In November 2017, the OHRC launched its inquiry into racial profiling and racial discrimination of Black persons by the TPS to help build trust between the police and Black communities. The goal of the inquiry was to pinpoint problem areas and make recommendations. This Interim Report describes what the OHRC has done to date. It provides findings relating to SIU investigations of police use of force resulting in serious injury or death, describes the lived experiences of Black individuals, and offers highlights of legal decisions.
October 1999 - The objective of the Paper is twofold: to promote dialogue on protecting human rights in the insurance industry and to examine alternatives to current practices by obtaining input from experts, regulators and consumers. Access to insurance in our society raises significant issues about distributive justice and fairness in the public sphere, issues that have received scant attention in Canada and in Ontario where rate setting has traditionally been viewed as a private matter.
October 2001 - In October 1999, the Ontario Human Rights Commission released a Discussion Paper for public consultation entitled Human Rights Issues in Insurance. This Consultation Report summarizes comments and viewpoints that were communicated to the Commission. The Report also examines possible directions to ensure human rights issues in insurance continue to receive attention in the future. A summary of relevant Code sections and selected case law is included in the appendices.
August 2011 - The Human Rights Project aims to provide time limited support to MCSCS in its ongoing initiatives aimed at identifying and eliminating any possible discrimination in the employment of MCSCS employees and in the delivery of services by MCSCS. This Project Charter details the agreed upon relationship to be established between the three parties to fulfill these aims.
2002 - Under the Ontario Human Rights Code, transit service providers have a legal responsibility to ensure that transit systems are accessible to all Ontarians. Many older persons depend of public transit services to go to work, to get to medical appointments, to go to the grocery store, to participate in recreational activities and to visit family and friends. Transit services that are not accessible can cause isolation and prevent participation of older persons in our communities.
