    Protecting the human rights of vulnerable Ontarians requires a radically different response to the issues of discrimination identified in the Commission’s consultation report, and the reports of numerous international bodies. We must all bring housing human rights into our homes, apartment buildings, property management offices, government offices, tribunals and commissions, and most importantly, into our collective awareness. This framework suggests concrete action to address the human rights issues identified in the consultation and in numerous reports on housing.

    The Commission recognizes that many landlords and housing providers across Ontario take their human rights obligations seriously and that a large percentage of tenants have decent housing. However, in this consultation, the Commission heard about the situations faced by tenants experiencing discrimination and systemic barriers in accessing and maintaining adequate and affordable housing.

    1. Defining discrimination

    The Code provides that every person has the right to be treated equally in the area of housing without discrimination because of any of the grounds set out in the Code. The purpose of anti-discrimination laws is to prevent the violation of human dignity and freedom through the imposition of disadvantage, stereotyping, or political or social prejudice.

    The Code contains provisions to help ensure that everyone has the equal opportunity to access housing, and the benefits that go along with it, without discrimination based on race, colour, ancestry, creed (religion), place of origin, ethnic origin, citizenship, sex (including pregnancy and gender identity), sexual orientation, age, marital status, family status, disability and receipt of public assistance. It also prohibits harassing behaviour in housing on the basis of these grounds.

    May 2008 - This report is the end result of a province-wide consultation on rental housing and human rights by the Ontario Human Rights Commission (the Commission). It documents what the Commission heard and aims to increase our collective understanding of human rights in rental housing. Individuals and organizations responsible for implementing and advancing housing rights protections need to feel “right at home” in understanding what obligations exist and how to fulfill them. Tenants also need to feel “right at home” in being able to access and live in rental housing that is free from discrimination.
  7. Minimum income criteria

    Those seeking rental housing who are in receipt of public assistance, as well as other Code-identified individuals with low incomes, have been particularly affected by the application of minimum income criteria. Many landlords apply a standard guideline that a tenant applicant should be spending no more than 25-35 percent of his or her income on rent. Those who fall short of this ratio are rejected.

  8. Spreading the message about human rights in housing: you can help!

    June 1, 2011 - At the Ontario Human Rights Commission, we have heard many stories of discrimination in rental housing. Some people face discrimination right at the beginning of their search – in rental housing advertisements. Tenants and advocates have brought a number of these ads to our attention. As a result, we are working with partners in housing and the media to increase awareness of human rights in housing, and find ways to prevent and address discriminatory ads.
