  1. OHRC seeks leave to intervene in racial profiling case

    Toronto - The Ontario Human Rights Commission is seeking leave to intervene as a friend of the Court in the “Neptune 4” case, being heard by the Toronto Police Service Disciplinary Tribunal. The action is part of a longstanding effort by the OHRC to tackle racial profiling – an issue at the heart of the Commission’s mandate to promote and advance respect for human rights in Ontario.

    Thank you for the opportunity to talk about the OPS’s Traffic Stop Race Data Collection Project. My deputation will be available online this afternoon, and the Ontario Human Rights Commission’s full report with our analysis of the findings will be available on our website tomorrow. This project was based on a 2012 settlement between the Ottawa Police Services Board and the Commission, after Chad Aiken, a young Black man, filed a human rights complaint alleging racial profiling.

    While many of the existing definitions of racial profiling, primarily originating in the United States, focus on law enforcement, the Ontario Human Rights Commission’s Terms of Reference define racial profiling more broadly to include any action undertaken for reasons of safety, security or public protection that relies on stereotypes about race, colour, ethnicity, ancestry, religion, or place of origin rather than on reasonable suspicion, to single out an individual for greater scrutiny or different treatment.

    Decision shows racial profiling as a form of everyday racism, confirms test for discrimination

    The OHRC intervened in Peel Law Association v. Pieters, where the Court of Appeal overruled a Divisional Court ruling, and held that the Divisional Court applied an overly strict test for discrimination. In its June 2013 decision, the Court of Appeal found that the HRTO was reasonable in concluding that the claimants were discriminated against because of race and colour.

    February 2014 - People with mental health disabilities are often among the most vulnerable people in Ontario. Many face a unique set of challenges where they live, in workplaces, or in our communities. When people are in crisis they also present a unique set of challenges to police services when considering the use of force. This leads to many concerns from a human rights perspective. It is not the role of the Ontario Human Rights Commission (OHRC) to comment on individual cases – we leave it to other experts to resolve these. But it is our role to look at common themes and concerns, and offer ways to move forward.
