  1. Discussion paper: Toward a commission policy on gender identity

    October 1999 - Research and consultation conducted by Commission staff in preparation for this paper shows that transgendered people experience negative stereotypes that have a pervasive and often traumatic impact on virtually every aspect of their lives. They are shunned by society and regarded with suspicion. Their jobs, housing and family lives are as threatened by the process of ‘coming out’ as by involuntary discovery. These are all issues that favour the development of a progressive policy to protect the human rights of transgendered persons within the legal framework of the Code.
  2. OHRC Submission to the Ministry of Children and Youth Services Review of the Child and Family Services Act

    The Ontario Human Rights Commission (OHRC) welcomes the opportunity to provide input to the government’s legislated review of the Child and Family Services Act (CFSA). Section 1 of Ontario’s Human Rights Code protects children from discrimination in services, because of race, ancestry, place of origin, colour, ethnic origin, citizenship, creed, sex, sexual orientation, gender identity, gender expression, marital status, family status or disability.

  3. OHRC submission regarding MGS Consultation: Change of sex designation on a birth registration of a minor

    The Ontario Human Rights Commission (OHRC) welcomes the Ministry of Government Services’ consultation regarding change of sex designation on a birth registration of a minor. The OHRC is concerned that the current government practice – which does not allow for a change of sex designation on the birth registration and certificate of persons under age 18 – is discriminatory on the basis of gender identity and gender expression.

  4. OHRC Submission to the Independent Review of Police Oversight Bodies

    November 2016 - For nearly two decades, the Ontario Human Rights Commission (OHRC) has raised concerns about systemic discrimination that are part of the culture of policing in our province. There have been far too many instances of racial profiling, discriminatory use of force on people with mental health disabilities and/or addictions, and racism and sexism in investigations of missing and murdered Indigenous women and girls in Ontario to ignore. These incidents and related concerns have sparked multiple coroner’s inquests, recommendations, reviews and reports, stretching back for decades. Yet they all have failed to eliminate systemic discrimination in policing.

  5. Submission of the OHRC to the MGCS regarding name and sex designation change information

    May 23, 2016 - The OHRC believes that MGCS’ current system for storing and sharing information relating to name and sex designation changes discriminates against trans people in violation of Ontario’s Human Rights Code, insofar as it fails to protect privacy and confidentiality relating to transgender status and transition history. Disclosing information of such a sensitive nature not only harms dignity, but also can expose people to significant barriers, disadvantage, and even health and safety risks.

  6. Re: Consultation document – revised criteria for change of sex designation on an Ontario birth registration

    July 25, 2012 - We are pleased to note that a key objective of the consultation is to develop revised criteria that are in accordance with the Human Rights Tribunal of Ontario’s decision dated April 11, 2012 in XY v. Ontario (Government and Consumer Services). We trust that this submission is of assistance in your development of revised criteria. We address the questions set out in your Consultation Document, and make additional observations.

  7. Ontario Human Rights Commission Submission regarding Section 57 three-year statutory review of the Ontario Human Rights System

    March 2012 - Ontario’s human rights system faces challenges unprecedented in our history. Across the province, our communities are changing. New groups are arriving in what were once homogeneous areas; the population is aging; there is a much greater awareness of the rights and needs of people with disabilities and a greater awareness of social justice issues in general, although much remains to be done.

  9. The shadow of the law: Surveying the case law dealing with competing rights claims

    This document explains the legal backdrop for the Commission’s Policy Framework. It is divided into two main sections. The first provides an overview and summary of key legal principles from some significant legal decisions. This section aims to help readers understand the relevant legal background when seeking to conciliate or otherwise reconcile competing rights claims. The second part of the document surveys the leading cases that deal with competing rights. It also provides examples of situations where the leading cases, and the key principles from them, have been applied by courts and tribunals. It is divided by the types of rights conflicts that most commonly arise. The cases are discussed in some detail as the specific factual context of each case is so important to the rights reconciliation process.
