Race and related grounds

Under the Code, every person has the right to be free from racial discrimination and harassment in the social areas of employment, services, goods, facilities, housing accommodation, contracts and membership in trade and vocational associations. You should not be treated differently because of your race or other related grounds, such as your ancestry, ethnicity, religion or place of origin. 

Canada, its provinces and territories have strong human rights laws and systems in place to address discrimination. At the same time, we also have a legacy of racism – particularly towards Indigenous persons, but to other groups as well including African, Chinese, Japanese, South Asian, Jewish and Muslim Canadians – a legacy that profoundly permeates our systems and structures to this day, affecting the lives of not only racialized persons, but also all people in Canada.

  1. OHRC Submission to the Ministry of Children and Youth Services Review of the Child and Family Services Act

    The Ontario Human Rights Commission (OHRC) welcomes the opportunity to provide input to the government’s legislated review of the Child and Family Services Act (CFSA). Section 1 of Ontario’s Human Rights Code protects children from discrimination in services, because of race, ancestry, place of origin, colour, ethnic origin, citizenship, creed, sex, sexual orientation, gender identity, gender expression, marital status, family status or disability.

  2. OHRC update: COVID-19 pandemic and the OHRC’s inquiry into racial profiling and racial discrimination of Black persons by the Toronto Police Service

    During the COVID-19 pandemic, the Ontario Human Rights Commission (OHRC) is working hard to continue its inquiry into racial profiling and racial discrimination of Black persons by the Toronto Police Service (TPS).

  3. de Lottinville and the application of Section 45.1 of Ontario's Human Rights Code

    February 25, 2015 - In the past, people who experienced discrimination or harassment by police had to decide whether to file an officer misconduct complaint under the Police Services Act (“PSA”) or an application with the Human Rights Tribunal of Ontario (“HRTO”). The PSA provides a public complaints process, revised through amendments in 2009 which also established the Office of the Independent Police Review Director (“OIPRD”). If they filed both, there was a real risk that their HRTO application would be dismissed.

  4. OHRC calls for reforms to immigrant detention system

    April 11, 2016

    Dear Minister Naqvi, I am writing today on behalf of the Ontario Human Rights Commission (OHRC), to express our concern about detention of non-citizens in Ontario jails under the federal Immigration and Refugee Protection Act (immigration detainees). 

    As you know, in my previous capacity as Executive Director of the International Human Rights Program at the University of Toronto Faculty of Law, I was the editor of a 2015 report on immigration detention (http://ihrp.law.utoronto.ca/We_Have_No_Rights).

  5. Letter to Secretary of Cabinet Davidson on anti-Black racism in the Ontario Public Service

    October 18, 2019

    Thank you for your letter dated July 26, 2019, and for meeting with the Ontario Human Rights Commission (OHRC) on September 17 to discuss the government’s efforts to address systemic anti-Black racism in the OPS. In addition to our meetings with your office, the OHRC has met with the Black OPS employee network (BOPSers), as well as with individual employees with personal experiences of anti-Black racism in the OPS.

  6. Joint submission to Ontario’s consultation on the 2020 budget: Necessary investments in Ontario’s correctional system

    Introduction

    This joint submission identifies concrete investments that should be earmarked in Ontario’s 2020 budget to protect the health and safety of vulnerable and marginalized Ontarians incarcerated in provincial institutions and the brave men and women working inside them.

  7. OHRC written deputation to the Toronto Police Services Board re: Police Reform in Toronto: Systemic Racism, Alternative Community Safety and Crisis Response Models and Building New Confidence in Public Safety

    The Ontario Human Rights Commission (OHRC) is providing this written deputation to the Toronto Police Services Board (TPSB) in response to its August 11, 2020, report on Police Reform in Toronto: Systemic Racism, Alternative Community Safety and Crisis Response Models and Building New Confidence in Public Safety and the recommendations it contains (Police Reform Report), which are being considered for approval at its August 18, 2019, meeting.

  8. New OHRC report confirms Black people disproportionately arrested, charged, subjected to use of force by Toronto police

    August 10, 2020

    A Disparate Impact, the second interim report in the Ontario Human Rights Commission’s inquiry into racial profiling and racial discrimination of Black persons by the Toronto Police Service (TPS), confirms that Black people are more likely than others to be arrested, charged, over-charged, struck, shot or killed by Toronto police.
