Race and related grounds

Under the Code, every person has the right to be free from racial discrimination and harassment in the social areas of employment, services, goods, facilities, housing accommodation, contracts and membership in trade and vocational associations. You should not be treated differently because of your race or other related grounds, such as your ancestry, ethnicity, religion or place of origin. 

Canada, its provinces and territories have strong human rights laws and systems in place to address discrimination. At the same time, we also have a legacy of racism – particularly towards Indigenous persons, but to other groups as well including African, Chinese, Japanese, South Asian, Jewish and Muslim Canadians – a legacy that profoundly permeates our systems and structures to this day, affecting the lives of not only racialized persons, but also all people in Canada.

  1. OHRC launches survey into Canadian experience requirement

    October 5, 2012

    Toronto – A new survey launched today by the Ontario Human Rights Commission (OHRC) asks job seekers and employers to describe how “Canadian experience” requirements in the Ontario job market have affected them. “In our conversations with newcomers, they often talk about the requirement for ‘Canadian experience’ as a big barrier to their entry into the workforce,” commented OHRC Chief Commissioner Barbara Hall, “We want to learn more about how this requirement plays out in real life.”

  2. MMAH Provincial Policy Statement Review on land use planning - OHRC letter

    December 7, 2012

    Dear Minister, Please find attached the submission of the Ontario Human Rights Commission (OHRC) regarding the Ministry of Municipal Affairs and Housing’s proposed amendments to the Provincial Policy Statement (PPS) 2005 on land use planning. The OHRC made an initial submission when your Ministry’s review began in 2010.

  3. MMAH Provincial Policy Statement Review on land use planning - OHRC submission

    November 23, 2012 - The Ontario Ministry of Municipal Affairs and Housing (MMAH) is proposing amendments to the Provincial Policy Statement (PPS) 2005 on land use planning issued under the Planning Act (Act). The Act requires the PPS be reviewed every five years. The Ministry began the review in March 2010. The Ontario Human Rights Commission (OHRC) is pleased to see proposed amendments that address some of the concerns and recommendations from its initial submission made in 2010 as well as other amendments that would further advance protection for human rights. The OHRC especially welcomes proposed additions that would recognize the interests of Aboriginal communities.

  4. Indigenous Peoples in Ontario and the Ontario Human Rights Code (brochure)

    2015 - The Ontario Human Rights Code is a provincial law that gives everybody the right to be free from discrimination in five parts of society – called social areas – based on one or more grounds. The five social areas are: employment, housing, services and facilities (such as education, health care, police, government, shops or restaurants), unions and vocational associations, and contracts or agreements.

  5. Celebrating the UN International Day for the Elimination of Racial Discrimination

    March 21, 2013

    Today, the Ontario Human Rights Commission (OHRC) joins human rights commissions and agencies across Canada and around the world in celebrating the United Nations (UN) International Day for the Elimination of Racial Discrimination. The day pays tribute to the tragic events of March 21, 1960 in Sharpeville, South Africa when 69 peaceful demonstrators were killed as they protested against apartheid. Canada was one of the first countries to support the UN initiative.

  6. Letter to the Toronto Police Services Board regarding the analysis of contact card data

    March 28, 2013

    Dear Dr. Mukherjee, I wish to commend the Toronto Police Services Board's (the "TPSB") approval of a project to collect and analyze data related to contact cards and the pattern of contact between the police and members of the community in general including young people from certain racialized communities. I also understand that the TPSB is seeking an opinion from the City Solicitor on the legality of the practice of carding and the issuance of receipts, which engages the issue of human rights-based data collection and analysis.

  7. Policy on Removing the “Canadian experience” barrier

    July 2013 - While the Ontario Human Rights Commission (OHRC) recognizes the significance of all of the barriers newcomers potentially face when trying to access the job market, this policy will focus on “Canadian experience” as an employment or accreditation requirement, and as a practice that raises human rights concerns. The OHRC’s position is that a strict requirement for “Canadian experience” is prima facie discrimination (discrimination on its face) and can only be used in very limited circumstances. The onus will be on employers and regulatory bodies to show that a requirement for prior work experience in Canada is a bona fide requirement, based on the legal test this policy sets out.

  8. Removing the "Canadian experience" barrier (brochure)

    Some employers ask people applying for jobs if they have “Canadian experience.” That can make it much harder for people new to Canada to find work. Some “regulatory bodies” (such as the professional associations for accountants or doctors) also ask for Canadian experience.

    The Ontario Human Rights Commission (OHRC) believes that asking for Canadian experience can result in discrimination. Employers and regulatory bodies should always have to show why Canadian experience is needed.
