Disability

The Code protects people from discrimination and harassment because of past, present and perceived disabilities.  “Disability” covers a broad range and degree of conditions, some visible and some not visible. A disability may have been present from birth, caused by an accident, or developed over time.

There are physical, mental and learning disabilities, mental disorders, hearing or vision disabilities, epilepsy, mental health disabilities and addictions, environmental sensitivities, and other conditions.

  1. Re: Initial Proposed Employment Accessibility Standard

    May 22, 2009 - The Commission recognizes the hard work of the Employment Accessibility Standards Development Committee in preparing the initial proposed Standard that sets out important requirements to help workplaces become fully accessible for applicants and employees with disabilities. The Commission’s submission details a number of issues for consideration by the Committee as it works to develop the final proposed standard.
  2. Re: Information Report on the Lynwood Charlton Centre (CM12005)

    Your Worship and Councillors, I am writing to restate my concerns about the human rights implications raised by the zoning application by the Lynwood Charlton Centre. As stated in my letter of January 24, 2012, applying the radial separation distance to this application makes one ask whether the City of Hamilton is creating discriminatory barriers for vulnerable people.

  3. Re: Draft regulation on Quality Assurance Measures for services and supports to adults with a developmental disability

    April 20, 2010 - The Ontario Human Rights Commission recently had an opportunity to review your Ministry’s draft regulation for application entities and service agencies that is being considered for enactment under the Services and Supports to Promote the Social Inclusion of Persons with Developmental Disabilities Act, 2008.
  4. Re: AODA Legislative Review

    October 30, 2009 - Dear Mr. Beer, Attached is the Submission of the Ontario Human Rights Commission (OHRC) regarding the Accessibility for Ontarians with Disabilities Act (AODA) Legislative Review. The OHRC’s observations and recommendations stem from a long history of promoting and enforcing the rights of persons with disabilities, including commenting on successive government legislation leading to the AODA.
  5. Re: Agenda items 7.(i) and 9.(vi): new comprehensive Zoning By-law, co-owned housing and communal dwellings

    March 17, 2014

    The OHRC provided guidance to the Township of Scugog about human rights principles relating to housing, as they considered amendments to their Zoning Bylaw relating to co-owned housing geared toward older Ontarians and people with disabilities. Following input from the community and the OHRC, the Township’s decision was to not create a special category, but treat the housing the same as any other residential housing.

  6. Questions and answers on cannabis and the Human Rights Code

    September 2018 - Cannabis or “marijuana” laws are changing in Canada. It will now be legal for people age 19 or older in Ontario to buy, possess, use and grow recreational cannabis. Provincial laws generally permit cannabis use wherever laws permit tobacco use. Cannabis use for a medical purpose (medical cannabis) continues to be legal.

    Employers and employees, housing providers and residents, and other organizations and individuals are asking about the implications under Ontario’s Human Rights Code.

  7. Public consultation paper: Human rights and mental health strategy

    November 2009 - The OHRC is developing a human rights mental health strategy to guide its activity in addressing systemic areas of discrimination affecting people with mental health disabilities. In September 2009, the OHRC started meeting with individuals and organizations in the field regarding human rights concerns faced by people with mental health disabilities. This second stage of consultation is aimed at soliciting your views to identify key approaches, issues and projects in these areas.
